ICANN Registrant Rights and Responsibilities
1. About This Document
This document is provided by Spin Design Pty Ltd as your domain name registrar in accordance with ICANN’s Registrar Accreditation Agreement, which requires accredited registrars to make this information available to registrants. The authoritative version of ICANN’s Registrant Rights and Responsibilities is published at www.icann.org. In the event of any inconsistency between this document and the authoritative ICANN version, the ICANN version will prevail.
Domain name registration is subject to the policies and rules of the relevant Registry and, where applicable, ICANN. Spin Design acts as a registrar or reseller and does not set Registry policy. Registrants must also comply with Spin Design’s Website Hosting Terms and Conditions, General Terms and Conditions, and Acceptable Use Policy, all of which are available at www.spindesign.com.au/terms-conditions/.
2. Registrant Rights
As a domain name registrant, you have the following rights under ICANN’s policies.
2.1 Accurate Information
You have the right to accurate and clear information about the products and services offered by your registrar, including the prices and terms and conditions for those services.
2.2 Non Discriminatory Service
You have the right not to be subjected to false advertising or deceptive practices by your registrar. You have the right to register domain names through any ICANN accredited registrar of your choice and to transfer your domain name between accredited registrars.
2.3 Transfer Rights
You have the right to transfer your domain name registration to another ICANN accredited registrar at any time, subject to the applicable transfer policy. Under ICANN’s Inter Registrar Transfer Policy, a registrar may not place unreasonable restrictions on transfers. Once a valid transfer request is submitted, the losing registrar must respond within five (5) calendar days. Transfers may be restricted only where the domain name: (a) was registered or last transferred within the preceding sixty (60) days; (b) is subject to a UDRP, URS, or other active dispute proceeding of which the registrar has been informed; (c) is subject to a court order from a court of competent jurisdiction; or (d) has been locked at the registrant’s own request. Outside of these specific circumstances, a registrar must not deny or unreasonably delay a valid transfer request.
2.4 WHOIS Privacy
You have the right to maintain the privacy of your WHOIS registration data through WHOIS privacy or proxy services where permitted by the applicable Registry. Where Spin Design provides a WHOIS privacy service, enabling that service is not considered a material change to registrant data, and Spin Design retains all original registrant data in accordance with ICANN requirements.
2.5 Dispute Resolution
You have the right to utilise ICANN’s Uniform Domain Name Dispute Resolution Policy (UDRP) or applicable dispute resolution mechanisms if you believe that a domain name has been registered in bad faith or in violation of your trade mark rights. 2.6 Registrar Change
You have the right to change your registrar at any time during your registration term, not only at its expiry. Your registrar may not prevent you from transferring to another registrar, and must comply with ICANN’s Inter Registrar Transfer Policy. Spin Design will cooperate with any valid transfer request in accordance with ICANN’s transfer policy.
2.7 Complaint Process
You have the right to file a complaint against your registrar with ICANN if you believe your registrar has violated its obligations under ICANN’s Registrar Accreditation Agreement. Complaints may be submitted via ICANN’s Contractual Compliance portal at www.icann.org/resources/pages/registrar-2012-02-25-en. 3. Registrant Responsibilities
As a domain name registrant, you accept the following responsibilities.
3.1 Compliance with Policies
You must comply with the terms and conditions posted by Spin Design as your registrar, including all applicable policies from the relevant Registry and ICANN, at all times during the term of your domain name registration.
3.2 Review of Registration Agreement
You must review Spin Design’s current registration agreement and all applicable policies, including any updates to those policies, at www.spindesign.com.au/terms-conditions/. You are responsible for staying informed of changes to the policies that govern your domain name registration.
3.3 Sole Responsibility for Domain Use
You assume sole responsibility for the registration and use of your domain name. This includes responsibility for:
- (a) ensuring that your use of the domain name does not infringe the intellectual property, trade mark, or other rights of any third party;
- (b) ensuring that the content published at your domain name complies with all applicable laws; and
- (c) all activities conducted through websites, email, or other services hosted at or associated with your domain name.
3.4 Accurate WHOIS Information
You must provide accurate and complete information for publication in WHOIS and other publicly available directories at the time of registration, and must promptly update this information to reflect any changes. Providing false or inaccurate WHOIS information is a breach of ICANN policy and may result in the suspension or cancellation of your domain name registration.
3.5 Responding to Registrar Enquiries
You must respond to enquiries from Spin Design within fifteen (15) calendar days. You must keep your Spin Design account contact information, including your email address and telephone number, current at all times. If you have selected automatic renewal for your domain name registration, you must also keep your payment information current to ensure that renewals are processed without interruption. In accordance with the 2013 Registrar Accreditation Agreement (RAA), Spin Design will issue you with an annual WHOIS data reminder notice asking you to review and confirm or update your WHOIS registration data. You must review and respond to that reminder within fifteen (15) days of receipt. Failure to maintain accurate WHOIS data may result in the suspension or cancellation of your domain name registration.
3.6 Renewal Obligation
You are responsible for ensuring that your domain name registration is renewed before its expiry date. Spin Design will endeavour to notify you of upcoming renewals by email to your registered contact address, but acceptance of responsibility for renewal confirmation rests solely with you. Spin Design is not responsible for the expiry, loss, or reregistration of a domain name by a third party where the Customer has not provided renewal instructions and payment in accordance with the Website Hosting Terms and Conditions.
3.7 UDRP Obligations
If a UDRP or other dispute resolution proceeding is commenced against your domain name, you are responsible for responding to that proceeding within the applicable timeframe. Failure to respond may result in a default decision against you and the transfer or cancellation of your domain name. You also retain the following rights in connection with any UDRP proceeding brought against your domain name: (a) if the UDRP complaint is decided in your favour, your domain name registration will be retained and no transfer or cancellation will occur; (b) if the UDRP complaint is terminated without a decision, you retain the right to recover or renew the domain name; and (c) if your domain name expires or is deleted during the course of a UDRP dispute, you retain the right to recover the name during the applicable redemption grace period. Spin Design will comply with all valid decisions issued by ICANN approved UDRP dispute resolution providers, including implementing orders to transfer or cancel domain names where required.
4. Australian Domain Names — auDA Policies
Domain names with the .au country code top level domain extension, including .com.au, .net.au, .org.au, .id.au, and others, are governed by auDA (the .au Domain Administration Ltd) in addition to the general registrant principles above. Key auDA requirements include:
- (d) registrants must satisfy the eligibility criteria applicable to their chosen .au second level domain (for example, .com.au requires an Australian registered company, trade mark, or business name connection);
- (e) registrants must maintain ongoing eligibility throughout the registration term;
- (f) the registered domain name must have a close and substantial connection to the registrant’s business or registered trade mark; and
- (g) WHOIS details for .au domain names must accurately reflect the registrant’s legal name and contact details.
auDA’s registrant policies are published at www.auda.org.au. Spin Design will notify the Customer if it becomes aware of a potential eligibility issue affecting a .au domain name in the Customer’s Account.
5. WHOIS Privacy and Data Publication
Where a domain name is registered through Spin Design, the registrant’s contact information may be published in publicly accessible registration data directories in accordance with Registry requirements and ICANN policies. Historically, this directory service has been known as WHOIS. ICANN is currently transitioning from the WHOIS protocol to the Registration Data Access Protocol (RDAP) as the authoritative registration data lookup system, as part of the 2023 global amendment to the Registrar Accreditation Agreement. Both systems may remain operational during this transition period. References to WHOIS in this document should be read to include RDAP and the Registration Data Directory Services (RDDS) framework where the context requires. Where Spin Design offers a WHOIS privacy or proxy service, the Customer may elect to have their personal contact details replaced with Spin Design’s details in the public registration data record, subject to the applicable Registry’s rules. Enabling WHOIS privacy does not affect the Customer’s underlying registrant rights or their obligations under this document. Spin Design retains all original registrant data in its records and will provide that data to law enforcement, courts, or regulatory bodies where required by law.
6. Domain Disputes
If you believe that a domain name has been registered in bad faith, infringes your trade mark, or was registered in violation of your rights, you may have recourse through the following mechanisms:
- (h) UDRP (Uniform Domain Name Dispute Resolution Policy): administered by ICANN approved dispute resolution providers including the World Intellectual Property Organization (WIPO) at www.wipo.int/amc/en/domains/ and the National Arbitration Forum (NAF);
- (i) URS (Uniform Rapid Suspension System): a faster, lower cost mechanism available for clear cut cases of trade mark infringement in new gTLDs; or
- (j) auDRP (au Domain Dispute Resolution Policy): for .au domain name disputes, administered by auDA and available at www.auda.org.au.
Spin Design will comply with all valid orders issued by approved dispute resolution providers in connection with domain names registered through Spin Design’s platform.
7. Acknowledgement
By registering or renewing any domain name through Spin Design, the Customer acknowledges that they have read, understood, and agreed to the registrant rights and responsibilities set out in this document and in ICANN’s published policies at www.icann.org. The Customer also acknowledges that they have been provided with details of how to access Spin Design’s registration agreement and this document at www.spindesign.com.au/terms-conditions/.
